Terms of Service

These terms will be reviewed by legal counsel before launch.

1. Service Description

KitchenTemp is a digital recordkeeping tool for restaurant temperature logging. The service assists with recording, organizing, and generating reports from temperature data entered by your staff.

KitchenTemp is NOT:

  • A food safety compliance system
  • A substitute for professional food safety consultation
  • A guarantee of passing health inspections
  • A replacement for proper food safety training

2. No Compliance Guarantee

We do not guarantee that using KitchenTemp will result in passing health inspections or achieving regulatory compliance. The service assists with recordkeeping only. Compliance with food safety regulations is solely the customer's responsibility.

3. Account Terms

  • One account per organization. The account owner is the primary contact.
  • The account owner is responsible for all activity on the account, including activity by staff members using PINs.
  • Staff PINs must be kept secure. Sharing PINs between staff members undermines the audit trail.
  • You must provide accurate account information.

4. Acceptable Use

  • Temperature logs in KitchenTemp are immutable by design. Attempting to falsify, manipulate, or circumvent the tamper-evident logging system is grounds for immediate account termination.
  • You may not reverse engineer, decompile, or disassemble the service.
  • You may not use automated scraping or bots to access the service.
  • You may not use the service for any illegal purpose.

5. Billing & Cancellation

  • Free trial: 14 days, no credit card required. Full access to your selected plan's features during the trial.
  • Subscriptions: Monthly or annual billing. Annual plans are billed upfront for the full year.
  • Upgrades: Prorated immediately. You pay the difference for the remainder of your billing period.
  • Downgrades: Take effect at the end of the current billing period.
  • Cancellation: Your account switches to read-only mode. You can view and export your data for 2 years. No surprise charges after cancellation.

6. Data & Privacy

Your data belongs to you. We provide export tools to download your data at any time. For full details on how we handle your data, see our Privacy Policy.

7. Limitation of Liability

  • KitchenTemp's total liability is capped at the amount of fees you have paid in the 12 months preceding the claim.
  • We are not liable for consequential, incidental, special, or punitive damages, including but not limited to: food spoilage, health inspection failures, fines, closures, or lost revenue.
  • The customer indemnifies KitchenTemp against claims arising from the customer's use of the service, including falsified records or non-compliance with food safety regulations.

8. Dispute Resolution

Any disputes arising from these terms will be resolved through binding arbitration. The arbitration will be conducted under the rules of the American Arbitration Association. Governing law: State of Delaware, United States.

9. Changes to These Terms

We will notify you of material changes at least 30 days in advance via email. Continued use of KitchenTemp after changes take effect constitutes acceptance of the updated terms.
